Special committee noted our MCC concerns-BASL

The BAR Association says a number of concerns highlighted in their observations of the Millennium Challenge Corporation agreement have been recognized by the Special Committee appointed by the President to study and submit a report on the agreement.

STATEMENT BY THE BAR ASSOCIATION OF SRI LANKA ON THE FINAL REPORT ON THE MCC SUBMITTED BY THE REVIEW COMMITTEE.

The attention of the BASL has been invited to several news items appearing in the Electronic and Print media relating to the handing over of the Final Report on the MCC Agreement by the special team appointed by HE the President to submit a review of the Proposed Agreement.

The Bar Association initially submitted their concerns on the MCC Agreement in 2019 when the signing of the Agreement appeared to be imminent. Our concerns were submitted after an in-depth study of the MCC, SOFA and the ACSA Agreements. The concerns were addressed to the former President HE Maithripala Sirisena and also to the former Prime Minister Hon Ranil Wickremesinghe.

Consequent to the election of the incumbent President the same concerns were addressed to HE Gotabhaya Rajapaksa in November 2019.

Thereafter, the BASL was invited by the review committee to submit further material on the matter and this was attended to promptly. A special team consisting of many respected members of the Bar made a collective effort to contribute towards the observations of the BASL.

We are pleased to note that a number of concerns highlighted in our observations have been recognized by the Special Committee and in this context are pleased to have contributed towards the final conclusions of the committee.

We are also pleased to note that the contents of the Committee Report will be made public as the BASL believes that the public has a right to know the contents of any such proposed agreement that has an immediate impact on the lives of the people.
